Terms and Conditions - Mallory Brook Farm Inc and User
These Terms and Conditions ("Agreement") govern your use of any products, services, or activities offered by Mallory Brook Farm Inc ("Mallory Brook Farm," "we," "us," or "our"). By engaging with our services, you agree to be bound by these Terms. For the purposes of this agreement, the term “User” refers to any individual, group, or organization who books, participates in, or utilizes any services, events, products, or facilities provided by Mallory Brook Farm Inc, either directly or indirectly. This includes, but is not limited to, farm stay guests, event attendees, workshop participants, membership subscribers, members, renters, and anyone acting on behalf of such individuals or groups.
General Terms
These Terms shall be governed by and construed in accordance with the laws of New York state, without regard to its conflict of law provisions. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Limitation of Liability
To the maximum extent permitted by applicable law, Mallory Brook Farm Inc shall not be liable for any indirect, incidental, special, consequential, punitive, nor any other damages, nor any loss of profits or revenues, whether incurred directly or indirectly, nor any loss of
data, use, goodwill, nor other intangible losses, resulting from (a) your access to or use of or inability to access or use the services or property; (b) any conduct or content of any third party on the services or property; or (c) unauthorized access, use, or alteration of your Mallory Brook Farm-approved stay for services or property. Mallory Brook Farm Inc’s total liability for any claim arising out of or relating to the services is limited to the amount you paid us, if any, in the six (6) months prior to the event giving rise to the claim.
No Liability for Damages or Losses
Mallory Brook Farm shall not be liable for any indirect, consequential, or special damages arising from the User's use or reliance on the rented land. This includes, but is not limited to lost profits, business interruption, loss of data, or any other similar damages. Mallory Brook Farm’s liability for any damage to the User's property or injury to the User or their guests is limited to the rental amount paid by the User for the period of rental. Under no circumstances shall Mallory Brook Farm be liable for any claims arising from personal injury, property damage, or any other losses that exceed the total amount paid for the land rental.
Arbitration Agreement
Any dispute, controversy, or claim arising out of or relating to this Agreement, or the breach, termination, or validity thereof, shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Commercial
Arbitration Rules. The place of arbitration shall be in Delaware County, in the state of New York. Judgment on the award rendered by the arbitrator(s) may be entered in Delaware County, New York. The parties waive their right to a jury trial or to participate in a class action.
User's Responsibility for Own Activities
The User agrees to fully inspect the land and property before use and to take all reasonable precautions to protect themselves, their guests, and their property. Mallory Brook Farm is not responsible for any accidents or incidents resulting from the User's activities or the activities of others on the property.
Assumption of Risk
The User acknowledges that the land and property provided by Mallory Brook Farm may contain inherent risks associated with outdoor activities, waterfalls, brooks, farming, and agricultural operations. These risks may include, but are not limited to, the presence of all
animals or insects, uneven terrain, exposure to the elements, tools and machinery. The User understands and accepts that encounters with wildlife, including potentially dangerous animals or insects, are an inherent risk of using rural or agricultural land. These risks may result in personal injury, allergic reactions, property damage, or other hazards. The User assumes full responsibility for these risks and agrees to use the land and its contents at their own risk.
No Duty to Remove Wildlife
Mallory Brook Farm Inc does not and cannot guarantee the absence of wild animals or natural hazards on or near the rented land. Mallory Brook Farm Inc is under no obligation to monitor, trap, relocate, or remove wildlife.
User Responsibility
The User assumes full responsibility for taking appropriate precautions, including but not limited to wearing protective clothing and footwear, checking for ticks or insect bites after use, properly storing food or waste, educating themselves and any guests about common local species and safety measures.
Weapons Prohibited on Premises
Unless pre-authorized approval has been granted by the owner of Mallory Brook Farm Inc, no weapons of any kind are permitted on Mallory Brook Farm, regardless of permit or legality. A pre-authorized request to possess a weapon on the premises must be sent exclusively to the owner of Mallory Brook Farm Inc and must be in writing. The owner of Mallory Brook Farm Inc is the only person permitted to approve or deny the possession of a weapon while on the property. The User of the property must have pre-authorized approval for such a request at least 7 days prior to entering the property. The term “weapons” includes but is not limited to: firearms (whether loaded or unloaded), ammunition, knives with blades exceeding 4 inches (excluding kitchen tools), explosives, fireworks, or pyrotechnics, bows, crossbows, slingshots, similar projectile weapons, or any
object carried with the intent to cause harm. This policy applies to all individuals, including members, visitors, contractors, volunteers, and event attendees — regardless of licensure or concealed carry status. Mallory Brook Farm reserves the right to deny entry or remove any individual found in possession of a weapon, and to notify law enforcement as necessary. No refunds will be issued for any stay or event interrupted due to violation of this policy.
Prohibited Drug Possession
The possession, use, distribution, or sale of illegal drugs or controlled substances is strictly prohibited on the property of Mallory Brook Farm. This includes: any federally or state classified illegal substances. Violation of this policy will result in immediate removal from the premises, and termination of any applicable agreements. No refunds will be issued in cases of dismissal for drug-related violations.
Liability Waiver
The User agrees to release, indemnify, and hold harmless Mallory Brook Farm Inc and its owners, employees, and agents from any claims, injuries, losses, or damages arising directly or indirectly from encounters with wildlife or natural hazards on Mallory Brook Farm Inc’s property.
Membership Services
By enrolling in the Mallory Brook Farm Membership Program (“Membership”), the member (“User”) agrees to the following benefits and Terms, effective for the duration of their active membership period:
Priority Registration & Discounted Rates:
Members receive priority registration for all workshops, classes, and events. A 15% discount is applied automatically at the time of registration.
Virtual Workshop Access
Each member is entitled to free access to 3 virtual workshops or classes per calendar year, chosen from our seasonal offerings. Additional virtual classes may be purchased at the membership rate.
Monthly Digital Resources
Members receive curated monthly digital resources, including growing guides, seasonal tips, behind-the-scenes insights, and short instructional videos delivered via email.
Invitations to Special Events
Members receive exclusive invitations to community gatherings, seasonal speaker series, and farm-based celebrations.
Overnight Camping Accommodations
Members are eligible for camping accommodations, subject to availability, on designated
nights. This includes access to dedicated land plots for personal use or exploration (details below).
Dedicated Land Access
The size of the rented land that members are granted access to will be determined by Mallory Brook Farm Inc on a case-by-case basis, dependent upon but not limited to the intended purpose of the land, the number of people that will be on the rented land, and other considerations. Plot use must comply with farm safety and ecological guidelines. Use is non-transferable and must be pre-scheduled. Members with granted land access may use the rented land for the sole purposes of recreation, personal retreat, education, community engagement, or nature-based learning, as outlined in their reservation or membership benefits. Use of the land and accommodations is strictly non-commercial unless otherwise authorized in writing by Mallory Brook Farm. The land and accommodations provided may only be used for the following approved activities: overnight camping or glamping in designated areas, educational or personal enrichment activities such as reading, journaling, nature observation, gardening, or rest participation in scheduled farm events, workshops, volunteer opportunities, and pre-approved group gatherings. Any and all gatherings and plans for the land use must be discussed and approved with the appropriate Mallory Brook Farm Inc representative prior to engaging in such activities. The following uses are strictly prohibited without written permission: hosting public events or gatherings, commercial filming or photography, sale of goods or services, construction or alteration of any land or structures, hunting, trapping, or removal of plants/wildlife, use of amplified sound systems or disruptive activity. Mallory Brook Farm reserves the right to remove any guest or terminate the agreement without refund if the land is used outside the permitted purpose or in a manner that endangers people, property, or the surrounding ecosystem.
Farm Event Access
Members receive free or discounted entry to public farm events and seasonal workshops. Pricing and availability vary per event.
Tool & Equipment Access
Members may access a limited selection of tools and farm equipment for use on-site only. Use outside of the property must be pre-approved, or subsequent fees and fines will apply. Proper care must be taken at all times.
Private Tour
Each membership includes one complimentary private farm tour per year, perfect for homeschool families, learning groups, or those seeking a deeper educational experience. Up to 6 guests included.
Educational Email Series
Members receive monthly educational emails, including growing tips, planting calendars, and insights from our farm team.
Complimentary Glamping Night
Members are eligible for one complimentary overnight stay per year in our seasonal glamping accommodations (based on availability and weather conditions). Reservations required.
Member Responsibilities: Volunteer Contribution
Each member agrees to contribute a minimum of 12 volunteer hours annually to support the farm's educational and ecological initiatives. Opportunities will be posted monthly and may include garden care, event help, outreach efforts, and other initiatives per the discretion of Mallory Brook Farm staff and leadership.
Refund Policy
Refunds will be processed based on the timing and nature of the cancellation at Mallory Brook Farm Inc’s discretion. No-shows or last-minute cancellations (within 24 hours of the scheduled service or event) are not eligible for refunds. In cases of inclement weather, emergencies, or unexpected closures by Mallory Brook Farm, clients will be offered the choice to reschedule their event date.
Cancellation Policy
Cancellations must be submitted in writing (email or text message acceptable) to Mallory Brook Farm within the following timeframes. Workshops & Classes: at least 7 days prior to the scheduled date for a full refund. Event Rentals or Private Bookings: At least 30 days’ notice is required for a full refund. Boarding or Long-Term Services: At least 14 days’ notice is required to avoid being charged for the upcoming billing cycle. Cancellations made after the above windows may be subject to a partial refund or credit toward future services, at the discretion of Mallory Brook Farm.
Updates to the Terms & Conditions and Website
We may revise and update these Terms & Conditions as necessary as possible and at our discretion. All changes are effective at the moment we post such changes and shall apply to all land access and use of Mallory Brook Farm’s tangible and intangible property. The User must verify these Terms & Conditions from time to time. The User’s continued access and use of their membership and website following a revision of the Terms & Conditions shall imply an acceptance of the changes. Mallory Brook Farm Inc may change the contents of the Terms & Conditions and the Website from time to time. However, this content is not necessarily complete or up-to-date and Mallory Brook Farm Ind is not under any obligation to update said content.
User’s Reliance
The information presented on the Website is only available for information purposes. Mallory Brook Farm does not guarantee the accuracy or completeness of this information. The User may not place reliance on the information on Mallory’s Brook Farm Inc’s website.
Mallory Brook Farm LLC disclaims any liability that could arise if any User, member, or visitor relies on such materials.
Mallory Brook Farm Code of Conduct
To ensure a safe, respectful, and enriching environment for all guests, members, staff, and the natural ecosystem, all individuals on the property of Mallory Brook Farm are expected to uphold the following Code of Conduct.
Respect for the Land: treat all natural elements, wildlife, and farm spaces with care. Stay within designated areas and do not alter or remove plants, soil, animals, or structures. Follow all posted signs and boundaries.
Community Conduct: be courteous, inclusive, and respectful toward others on the land. Harassment, hate speech, discrimination, or any form of intimidation will not be tolerated. Supervise children and guests at all times. We are not responsible for any harm that may come to you, your children, nor your pets.
Behavior: no disruptive, aggressive, or reckless behavior will be tolerated. Campfires or open flames are only allowed in designated areas that have been pre-approved by the Mallory Brook Farm Inc owner and must be monitored at all times. The User will have full responsibility to pay any and all damages that occur as a result of their campfire or use of property that causes any fire or other damage to any of the contents of the property and the land itself including wildlife, trees, any and all structures, and any other property at the discretion of Mallory Brook Farm Inc.
Pets & Animals: pets are allowed only with prior approval. Guests are responsible for cleaning up after their animals and ensuring they do not disturb wildlife or other guests. We are not responsible for harm caused to your pets & animals under any circumstances.
Volunteer & Participation Etiquette: volunteers and members must honor scheduled commitments and communicate if unable to attend. During workshops or shared land use, cooperative and respectful collaboration is expected.
Clean-Up & Leave-No-Trace: all personal belongings, trash, and waste must be packed out or properly disposed of before departure. “Leave it better than you found it” is a guiding principle for all visitors and guests.
Enforcement
Violation of this Code of Conduct may result in immediate removal from the premises, revocation of membership or privileges, termination of rental or stay agreements, or in serious cases, involvement of local law enforcement.
Entire Agreement
This Agreement constitutes the entire understanding between Mallory Brook Farm Inc and the User with respect to the rental and use of the land described herein. It supersedes all prior negotiations, understandings, discussions, representations, or agreements, whether written or oral, relating to the subject matter of this Agreement. No amendment, modification, or waiver of any part of this Agreement shall be valid unless made in writing and signed by both parties.
No Rights or Claims to Property
The User understands and agrees that their access to or use of any portion of Mallory Brook Farm’s property does not grant or convey any ownership interest, leasehold, easement, or other legal or equitable rights in the land. The User expressly waives any and all rights to assert claims of adverse possession, prescriptive easement, or any similar claim of ownership or long-term entitlement to the property, regardless of the duration, frequency, or nature of their use. Use of the land is permissive, revocable at any time by Mallory Brook Farm Inc, and contingent upon compliance with all applicable agreements and policies.
Mallory Brook Farm reserves the right to enforce these policies at its sole discretion in order to protect the land, community, and safety of all individuals on the premises. In the event that a User violates any of the policies, Terms, or agreements outlined herein, Mallory Brook Farm Inc reserves the right to pursue appropriate legal remedies, including but not limited to damages, fines, and injunctive relief. Any legal disputes arising from such violations shall be governed by the laws of the State of New York and shall be litigated exclusively in the courts of Delaware County, New York.
